Aeronovous is a Canadian drone inspection service provider operating under the following credentials:

  • Transport Canada Advanced Operations Pilot Certificate
  • Special Flight Operations Certificate (SFOC) where required
  • Comprehensive liability insurance coverage
  • Compliance with Canadian Aviation Regulations (CARs) Part IX

Aeronovous provides professional drone inspection and aerial data collection services, including:

4. Client Responsibilities and Obligations

4.1 Pre-Service Requirements

Clients must:

  • Provide accurate property information, site access details, and project specifications
  • Obtain necessary permissions for drone operations on private property
  • Disclose any known hazards, restrictions, or safety concerns at the inspection site
  • Ensure compliance with local bylaws and property access requirements
  • Provide adequate notice for scheduling and any changes to inspection plans

4.2 Site Access and Safety

  • Ensure safe and legal access to inspection sites
  • Identify and communicate any site-specific hazards or restrictions
  • Coordinate with building occupants, security, or other stakeholders as needed
  • Comply with all applicable health and safety regulations

4.3 Legal and Regulatory Compliance

  • Use services only for lawful purposes and in compliance with applicable laws
  • Respect intellectual property rights and confidentiality obligations
  • Not interfere with drone operations or attempt to access restricted data
  • Indemnify Aeronovous against claims arising from client's breach of these obligations

5. Service Limitations and Conditions

5.1 Operational Limitations

Our services are subject to:

  • Weather Conditions: Operations may be delayed or cancelled due to adverse weather
  • Regulatory Restrictions: Compliance with Transport Canada regulations and airspace restrictions
  • Technical Limitations: Equipment capabilities and technological constraints
  • Site Conditions: Physical access limitations and safety considerations

5.2 Service Modifications

We reserve the right to modify, suspend, or discontinue services with reasonable notice. Changes may be necessary due to regulatory updates, safety concerns, or business requirements.

5.3 Force Majeure

We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, or technical failures.

6. Intellectual Property and Data Ownership

6.1 Aeronovous Intellectual Property

All proprietary technology, software, methodologies, and know-how used by Aeronovous remain our exclusive intellectual property. This includes AI algorithms, analysis techniques, and proprietary processes.

6.2 Client Data Rights

Clients retain ownership of data specifically collected for their projects, subject to the following:

  • Aeronovous retains the right to use data for service delivery, quality assurance, and legal compliance
  • Anonymized or aggregated data may be used for research, development, and service improvement
  • Clients receive a limited, non-exclusive license to use deliverables for their intended business purposes
  • Redistribution or commercial use of data requires separate written agreement

6.3 Third-Party Rights

Clients must ensure they have appropriate rights and permissions for properties and areas to be inspected. Aeronovous is not responsible for third-party intellectual property or privacy claims.

7. Payment Terms and Pricing

7.1 Pricing and Quotes

  • Service pricing is provided in written quotes valid for 30 days unless otherwise specified
  • Prices are in Canadian dollars and exclude applicable taxes unless stated otherwise
  • Additional charges may apply for expedited services, travel, or scope changes

7.2 Payment Terms

  • Payment terms are net 30 days from invoice date unless otherwise agreed
  • Late payments may incur administrative fines as permitted by law
  • Clients are responsible for all collection costs and legal fees for overdue accounts

7.3 Cancellation and Refunds

  • Cancellations with less than 24 hours notice may incur charges
  • Weather-related cancellations do not incur charges
  • Refunds are provided only in cases of service non-delivery due to our fault

8. Limitation of Liability and Disclaimers

8.1 Service Disclaimers

Our services are provided "as is" and "as available." We make no warranties, express or implied, regarding:

  • The accuracy, completeness, or reliability of inspection results
  • The suitability of our services for any particular purpose
  • Uninterrupted or error-free service delivery
  • The detection of all defects or conditions

8.2 Limitation of Liability

To the maximum extent permitted by law, Aeronovous's total liability for any claim shall not exceed the amount paid by the client for the specific service giving rise to the claim. We shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from third-party claims or actions
  • Delays or failures due to circumstances beyond our control

8.3 Professional Standards

Our services are performed in accordance with industry standards and best practices. However, drone inspections have inherent limitations and may not detect all defects or conditions.

9. Insurance and Indemnification

9.1 Insurance Coverage

Aeronovous maintains comprehensive insurance coverage including:

  • Commercial general liability insurance
  • Professional liability coverage
  • Drone/UAV specific insurance
  • Equipment and technology coverage

9.2 Client Indemnification

Clients agree to indemnify and hold harmless Aeronovous from claims arising from:

  • Client's breach of these Terms or applicable laws
  • Inaccurate information provided by the client
  • Third-party claims related to property access or permissions
  • Misuse of inspection data or deliverables

10. Privacy and Data Protection

Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our privacy practices as described in the Privacy Policy.

We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable Canadian privacy laws.

11. Dispute Resolution and Governing Law

11.1 Governing Law

These Terms are governed by the laws of Newfoundland and Labrador and the federal laws of Canada. Any disputes shall be subject to the exclusive jurisdiction of the courts of Newfoundland and Labrador.

11.2 Dispute Resolution

We encourage resolution of disputes through direct communication. If formal dispute resolution is necessary, parties agree to attempt mediation before pursuing litigation.

12. Modifications and Updates

We reserve the right to modify these Terms at any time. Material changes will be communicated through:

  • Updated effective date on this page

Continued use of our services after changes constitutes acceptance of the updated Terms.

13. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy and any signed service agreements, constitute the entire agreement between the parties.
